When opening an investment account most brokerage houses include a provision which requires the investor who has a complaint for money damages against his or her broker or brokerage firm to have the matter decided at an arbitration proceeding.
Arbitration is like a trial but without a jury. The judge(s) are a panel of 1 or 3 (depending on the amount of the claim) qualified arbitrators who act as judge to decide the outcome of the action.
WHAT ARE MY CHANCES OF WINNING AT ARBITRATION?
80% of all customer cases settle in favor of the investor prior to the rendering of an arbitration award according to the Securities Arbitration Commentator, a periodical publication. Over half of the remaining 20% that do not settle prior to arbitration result in an award to the customer. While our firm cannot guarantee success, we will not accept a case unless we believe there is merit to the client's claim and that some monetary recovery is warranted.
